Terms of Service

 

1. General

a) These general terms and conditions apply exclusively to the business relationship between the REAL MARRIAGE dating agency and the customer.

b) For any fee-based services, those terms and conditions of use that are valid at the time and apply to the respective service also apply.

c) The subject of the contract includes the provision of services with the aim of marriage mediation, marriage initiation or a continuing partnership.

d) REAL MARRIAGE reserves the right to change the service description. The fees to be paid by the customer depend on the services commissioned and - insofar as

nothing different has been agreed - the price list valid at the time of the order.
 

2. Privacy

a) As part of the contractual service provision, personal data is collected, stored, processed and used. Personal data are those that contain information about

personal and factual circumstances of a specific or identifiable customer.

b) REAL MARRIAGE undertakes to comply with the legal provisions on data protection, in particular the Data Protection Act (BDSG) and the law on data protection for teleservices

(TDDSG) to be observed.

c) REAL MARRIAGE is entitled to use and process personal data for the purpose of providing advice and for the needs-based design of the services. In addition, is

REAL is entitled to transmit personal data to third parties for the purpose of the contractually agreed service provision within the framework of the contractual relationship.

d) REAL MARRIAGE will provide the customer with complete information free of charge at any time on request about the stored data as far as it relates to this customer.
 

3. Use of the Database

a) Before using the services that are subject to a fee, the customer is informed that these services are subject to a fee and what fees are incurred.

b) With an order, a contract is concluded between the customer and REAL MARRIAGE, to which these General Terms and Conditions apply.

c) A customer can only become a person who has reached the age of eighteen. REAL MARRIAGE treats personal data with absolute confidentiality.
 

4. Terms of  Use

a) The customer fills out the information in his profile truthfully and also manages his profile truthfully. Each customer is responsible for their own information. This applies in particular to the photos. REAL MARRIAGE has no way of checking this and expressly distances itself from any information.

b) Customer will treat e-mails and other communications between it and other customers, or between customers generally, as confidential. Without the consent of the person concerned, the customer is not authorized to pass on the data to third parties.

c) The use of databases and the use of the services of REAL MARRIAGE is exclusively for private purposes. Commercial use in any form is expressly prohibited.

d) The customer is not allowed to use the services of REAL MARRIAGE in an offensive and abusive way, in particular to:

• disseminate defamatory, indecent, pornographic or otherwise illegal material;

• to threaten, harass or violate the rights (including privacy rights) of others;

• adversely affect the availability of the offers for other users of the databases

• Intercept or attempt to intercept members' emails

• Contact customers to offer goods or services.
 

5. Disclaimer

a) REAL MARRIAGE assumes no liability for the content of external links. Despite careful checking of the content, misuse cannot be ruled out.

b) REAL MARRIAGE assumes no liability for the content of the customer profiles, in particular the truthfulness of the photos, and the correspondence between the members of the database. Here, too, a review can only take place to a limited extent, but not completely. The user expressly distances himself from profile information.

c) REAL MARRIAGE's liability for any damage that does not consist of injury to life, limb or health is limited to intent and gross negligence

d) REAL MARRIAGE assumes no liability for the correctness of the address information. The user only acts as an intermediary for addresses for the purpose of non-commercial use. Any claims regarding an incorrect address are limited to the amounts paid for the procurement of address.
 

6. Offsetting / right of retention

The customer can only offset his own claims against REAL MARRIAGE or assert a right of retention if his claim has been legally established, is undisputed or recognized.
 

7. Advertising

REAL MARRIAGE is entitled to send advertising to the customer about the services it offers.
 

8. Jurisdiction

a) The law of the Federal Republic of Germany applies to the contractual relationship between REAL MARRIAGE and the customer, excluding the German conflict of laws.

b) The exclusive place of jurisdiction for all disputes arising from this legal relationship is Kassel if the customer does not have a general place of jurisdiction in the Federal Republic of Germany.
 

9. Right of Withdrawal

The customer can revoke his contract declaration within 14 days in text form (letter or fax) without giving reasons. The period begins after receipt of this instruction in text form, but not before the conclusion of the contract and not before we have fulfilled our information obligations in accordance with Article 246 § 2

EGBGB in connection with § 1 paragraph 1 and 2 EGBGB as well as according to § 312e paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. Sending the cancellation in good time is sufficient to meet the cancellation deadline. The revocation must be sent to:

In the event of an effective revocation, the mutually received services are to be returned.

If the customer cannot return the received service in whole or in part or only in a deteriorated condition, the customer must compensate REAL MARRIAGE in this respect, if necessary

ensure that the customer nevertheless has to fulfill his contractual payment obligations for the period up to the revocation.

The right of withdrawal expires prematurely if the contract has been completely fulfilled by both parties at the express wish of both parties before the right of withdrawal has been exercised.
 

10. Miscellaneous

Should individual provisions of these General Terms and Conditions be or become legally ineffective, the remaining provisions of this agreement shall remain unaffected. The ineffective provisions of the contractual partners are replaced by regulations that come as close as possible to the economic purpose of the original regulation. The same applies to any gaps in the contract.
